By entering into a business agreement under these TERMS & CONDITIONS with Custom Neon Sign Art (the vendor), you (the purchaser) agree to and are bound by the following TERMS & CONDITIONS of the offer. From now on, ‘you’ refers to the customer/purchaser, and ‘us’/’we’/’our’/the vendor refers to Custom Neon Sign Art.

THE USE OF OUR CUSTOM LED NEON SIGN MAKER

By accessing or using our Custom LED Neon Sign Maker, you agree to be bound by these Terms and any applicable laws and regulations. If you do not agree with these terms, please refrain from using the Website. Upon creating your neon sign and clicking ‘Go Checkout‘/Submitting your custom neon design, an account will be created automatically for you and will send an email / SMS or even a WhatsApp message if applicable regarding your login information, neon sign mockup quote or at times adjusted pricing base on available sizing of your neon sign. Our Neon Sign Maker creates instant pricing for your benefit before your order but we cannot promise that it will be 100% accurate due to the spacing/font style of your neon size design, We will try our best to best fit your needs and to meet your sign specification requirements. You will be responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

NEON SIGN MAKER PRICING ACCURACY

We make every effort to ensure the accuracy of pricing information displayed on our website. However, in the event that a product is listed with an incorrect price due to a typographical error, technical glitch, or any other reason, we reserve the right to rectify and adjust the pricing.
You will be notified of the corrected price before your order is processed and may choose to proceed with the purchase at the corrected price or cancel your order.
In the event that you have already completed the purchase at an incorrect price, we will contact you to discuss the necessary adjustments.

Adjusted Pricing: If we find an error in the pricing of the product you have purchased, we may:  Refund you the overpaid amount, if you have been charged more than the correct price. Request additional payment if you have been charged less than the correct price, and you wish to proceed with the purchase at the correct price. Cancel the order if you prefer not to proceed with the adjusted pricing.

Notification & Consent: We will make every effort to promptly notify you of any pricing errors or adjustments. It is your responsibility to provide accurate contact information to facilitate communication in case of such errors. By completing the purchase on our checkout page, you consent to the possibility of pricing adjustments as outlined in these terms and conditions.

Neon Purchased & Refund Policy:

By agreeing to these terms and conditions, you authorize us to charge your payment method for the corrected amount if an adjustment is required. Neon Maker Refund Policy: In the event of an overpayment or a canceled order due to pricing adjustments, we will issue a refund to your original payment method in a timely manner. Contact Information: Please ensure your contact information, including email and phone number, is up to date and accurate to facilitate communication regarding pricing adjustments.

UPLOAD FORM or GET A QUOTE FORM & COUPON CODE

By using the Upload Form or obtaining a coupon from our website, you agree to be bound by these terms and any applicable laws and regulations. If you do not agree with these Terms, please refrain from using the Upload Form or Coupon Sign-up Form. Upon uploading your file(s) or by signing up to our Coupon Form and submitting your data, an account will be created automatically for you and will send an email / SMS or even a WhatsApp message if applicable regarding your login information, neon sign mockup quote, adjusted size, and pricing or even Free Coupon Code if eligible for your later checkout.

ACCOUNT TERMINATION

We reserve the right to terminate your account or restrict your access to the Website at our sole discretion, without notice, for any reason, including a breach of these Terms.

SHOP QUOTE PRICE

SHOP CUSTOMIZED LIGHTS
A. TERMS
We must receive full payment for the products ordered before your requested neon sign can go into production. Our acceptance of your order creates a legally binding agreement between us and you.
B. ORDERS
All orders will be laid out in a quote, which must be accepted for an order to proceed. Responsibility for the acceptance of this quote lies solely with the customer: mistakes cannot and will not be replaced once your order has entered the production process. Acceptance of the quote and acceptance/payment of the invoice means you have agreed to all of our Trading Terms and Conditions.

C. CRAFTSMANSHIP AND STYLE
All colors displayed on the website are only as accurate as the website design process allows and will vary with your screen settings, software, natural light, etc. In matching, there will always be variations due to screen resolution, environmental factors (such as lighting), perspex color effects on the inks, and varying color properties.

Due to variation in the manufacturing stage and the handmade nature of LED neon lights, there may be a variation of up to 100mm in any dimension set out in the quote. Some variations can and may occur between the stated position, start, and the final position of any design ordered. By agreeing to these T&Cs, you understand that variation in dimensions, position, color, and visual appearance can vary among products and agree to allow us to use our professional judgment in this matter.

D. COPYRIGHTED STYLES & SUPPLIED STYLES
It is the customer’s responsibility to obtain permission to use any copyrighted, trademarked, or otherwise licensed material/logos in their order.

E. STYLES MADE BY US
Any designs produced by us for you will remain our intellectual property and may not be used in any other form without our prior written consent.
F. STYLES
We may occasionally use examples of individually LED neon lights we’ve previously produced in our catalogs, websites, social platforms, displays, and pitches. If you would like to opt-out or keep your relationship with us discreet, please let us know in a word by clearly stating your request or artwork approval.

G. RETURNS
Custom signs are reflected manufacturing service whereby we manufacture personalized goods to your specifications, and therefore refunds and returns of goods are not possible. We therefore encourage customers to take care with the specifications and to understand the TERMS & CONDITIONS of their order. By making a purchase order or by signing off on the quote and invoice, you agree to pay for the goods listed and understand that no refund, replacement, or compensation can be claimed for the goods once the order has been placed. This does not affect your legal rights.

H. AVAILABILITY
From time to time, there may be shortages or stock-outs between the time availability was last checked (receipt) and when the stock is drawn for the initial payment, especially if there is a delay in payment. In such cases, we will inform you as soon as possible and offer substitute options (which may affect the price, resulting in an additional invoice to you or adjustment advice from us) or may offer to ship the products shortly after. The rest of the order will continue even in the case of a stock-out and cannot be cancelled due to stock-outs. We are not liable for any loss of revenue resulting from stock-outs or delays in the production process.

Any changes to an order will result in a new quotation. Each new quotation supersedes all prior quotations.

I. WORK TIME
Our standard modified order turnaround time is 1-2 days. This may be extended up to 3 days or more for complex orders or during busy periods. Once your paid order is closed, it enters the production cycle, and we will provide you with a tentative completion date.

Failure by the customer to promptly respond to requested information from our sales representatives may result in order delays.

All turnaround times are estimates, and we cannot guarantee accurate delivery dates. We are not responsible for any loss caused by production or delivery delays.

J. CANCELLATIONS AND REFUNDS
Once an order has been placed and paid for, the manufacturing stage begins immediately, and costs are incurred immediately by us. Therefore, we emphasize that orders cannot be canceled once placed. Returns and refunds are not accepted.

K. COLORS
All colors shown on the website are only as accurate as the website design process allows. There will always be variations due to screen resolution and environmental factors such as lighting.

L. TITLE
We retain full title in the goods until we receive full payment. We reserve the right to sell any rejected goods.

RETURNS AND EXCHANGES

REFUNDS/ DEFECTS/ RETURN OF OFF-THE-SHELF LIGHTS (LIGHTS BOUGHT DIRECTLY FROM THE WEBSITE)

A. GOODS DELIVERY HANDLING RESPONSIBILITY
You must ensure that you have adequate and appropriate equipment, and your own designated staff are available to receive the delivered products at your premises, as the delivery company’s drivers are not obliged to provide assistance.
Once the product has been delivered, there is no exchange or return policy at Custom Neon Sign Art. However, in the case of any manufacturing defect, we will replace your product within a valid warranty time period.

DELIVERY
Every package delivered is insured from the point it leaves our factory until it reaches your doorstep. Any damage that occurs to the sign after that is not Custom Neon Sign’s responsibility. We use various reputable delivery companies, who, if you are not at home at the time of delivery, will leave a delivery note so you can arrange redelivery. You will also receive an email with tracking details when your light is dispatched from the studio.

B. WE DON’T ACCEPT CANCELLATIONS
Please contact us if you have any problems with your order.

C. DELAYS BEYOND OUR CONTROL
Order delivery delays may occur due to events or circumstances beyond our reasonable control, such as strikes, lockouts, and other industrial disputes.

INTERNATIONAL DELIVERIES
All international shipments are delivered through one of our trusted couriers, FedEx/DHL. As per our TERMS & CONDITIONS, the client accepts responsibility for any additional charges on rejected packages. We do not accept returns for international orders. This does not affect your legal rights. We offer Free Worldwide Shipping. You can expect to receive your sign within 1-4 weeks after the order date. We may ship some signs from our production facility in Hong Kong.

WARRANTY

We strive to provide high-quality products that meet merchantable standards. However, if the customer alters the light or wires during installation, the warranty is void.
If the product is defective, we will replace it at our discretion with a sign of comparable style and value.

A. WARRANTY GUARANTEE
The warranty does not cover damages resulting from carelessness, accidents, theft, inadequate maintenance, damage by others, or failure to prevent damage caused by chemicals, ice, or snow.

The warranty also does not cover products exposed to harmful, nuclear, or corrosive conditions, or operating temperatures outside the range of -40 to 60 degrees Celsius.

B. LIABILITY
Custom Neon Sign will not be liable for loss of profit or significant losses resulting from incorrect delivery, production, delivery delay, or any other cause.

GOVERNING LAW
The agreement between you and us will be governed by English law, and any disputes will be resolved exclusively by the English courts.

A. CONFIDENTIALITY
All information provided is confidential, and the confidentiality obligations in these Terms and Conditions will remain in effect even after the end of our relationship.

B. INTELLECTUAL PROPERTY
All intellectual property related to our brand, supply chain, processes, and other business components remain our own. Customers are not allowed to use our intellectual property without our written permission, which expires when we terminate our relationship.

C. ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between us and govern the supply of goods and services by us to you.

(a) By purchasing our products and/or services, you acknowledge and accept these Terms and Conditions.

(b) All communication and documentation will be in English, and the English version will prevail if there are conflicts with translations in other languages.
